Is a Pool Safety Certificate Required When Selling in Queensland?
Yes. Under the Building Act 1975 (Queensland) and the Pool Safety Act 2010, all swimming pools and spas in Queensland must comply with the state's pool safety laws. When selling a property with a pool, you have two options:
- Option 1 (Recommended): Provide the buyer with a valid pool safety certificate at settlement.
- Option 2: Issue the buyer a Form 36 (Notice of No Pool Safety Certificate), which allows the buyer 90 days after settlement to obtain one at their own cost.
Most real estate agents and buyers' solicitors will strongly prefer Option 1. A Form 36 gives buyers leverage to negotiate down the purchase price, and some buyers will walk away entirely. Getting your certificate before you list removes that risk entirely.
What Does the Inspection Cover?
Our QBCC licensed pool safety inspector will assess your entire pool barrier against Queensland's current pool safety standard, including:
- Pool fence height, condition, and structural integrity
- Self-closing and self-latching gate mechanisms
- The non-climbable zone (NCZ) — the 900mm zone on the outside of the fence
- Fence footings and any gaps at the base
- Pool signage (including a current CPR sign displayed at the pool)
- Any climbable objects within the non-climbable zone (furniture, plant pots, metre boxes)
- House walls, doors, and windows forming part of the pool barrier
If your pool passes, we lodge the certificate with QBCC immediately and you receive your official certificate within 2–3 business days.
What If My Pool Fails?
Don't panic. The most common reasons pools fail inspection are also the cheapest and easiest to fix:
- Gate latch not self-latching correctly (often a simple adjustment)
- Gate not fully self-closing (spring tension adjustment)
- Vegetation or objects in the non-climbable zone (trim or relocate)
- Fence panel loose or damaged (repair or replacement)
- CPR sign missing or out of date (replace for under $20)

Tips for Sellers — Before You Book
- Check all gate latches open and latch properly from both sides
- Remove any pot plants, garden furniture, or bikes within 900mm of the outside of the fence
- Trim overhanging trees or shrubs near the fence line
- Ensure your CPR sign is displayed poolside and is current (revised guidelines apply)
- Check for any gaps at the base of the fence where a child could squeeze through
